KINNAIRD FISHINGS CONDITIONS OF LET

• All tenants must ensure that the names of all fishers are entered in the book in the hut. Anyone found to be fishing without having written their name in the book will automatically be regarded as in breach of Section 1 of the Salmon and Fresh Water Fisheries (Protection) Act 1951, as amended by the Freshwater and Salmon Fisheries (Scotland) Act 1976 and the Salmon Act 1986, and steps will taken to initiate a prosecution for illegal fishing.
• The subjects of let comprise the rights of fishing only and the Trustees do not accept responsibility for natural hazards and adverse climatic conditions affecting the catching of salmon.
• Anyone coming onto lands owned by the Trustees in order to exercise the fishings does so at his or her own risk and the Trustees will accept no responsibility for any loss or injury sustained. You are required to hold suitable third party liability insurance cover to indemnify both yourself and all guests against all claims of whatever nature which may arise from the exercise of the fishing let.
• You will exercise the Fishing Rights herein conferred in a fair and sportsmanlike manner and will at all times comply with the provisions of the 1951 Act (as amended). In particular and without prejudice to the foregoing generality the following are expressly prohibited:-  Worming On the Upper Beat fishing in the two pools immediately below the fish pass at the dam. The use of lead core flylines, lead core sunktips, high density fast sinking flylines or use of additional weights attached to flylines, casts or weighted flies. Spinning after the hours of darkness. The use of natural or dyed prawns or shrimps. The method of fishing known as stroke hauling.
• You and your authorised guests must exercise care and consideration in driving vehicles over access roads leading to the river. Vehicles should be parked only at the fishing hut on each beat and are not, in any circumstances, to be taken along the river banks. On the Upper beat they may also be parked on the right bank at the footbridge.
• In addition to the conditions stipulated in 3 above the following restrictions will apply:- Up to 30th April all salmon and sea trout caught must be returned to the water in accordance with Scottish Government’s Conservation Plan for a Category 2 river. From 1st May to 15th June it is strongly recommended that all salmon and sea trout caught should be returned to the water. From 16th June to the end of the season it is recommended that all salmon and sea trout be returned to the water.
• Fishing should be with single or double barbless hooks only. Notwithstanding the above all red salmon and henfish ripe with spawn shall be returned carefully to the water unless badly damaged in capture.
• All fish foul hooked shall be carefully returned to the water.
• All fish less than 9 inches in length shall be carefully returned to the water.
• You and your authorised guests will co-operate in the prosecution of poaching, and are asked to report immediately to the Factor, the River Keeper, any Police Officer, or a River Bailiff fishing by unauthorised persons on beats let to you.
• If you or any of your authorised guests bring dogs to the river, you must ensure that they are at all times kept under control and in particular do not worry livestock or otherwise cause nuisance to the Trustees or occupiers of adjoining land.
• The fishing huts are provided as shelters and lunch huts and are not to be used as sleeping places. There should be no cooking within the huts. Barbecues, if used, should be placed on the stone slab outside the hut, so as not to burn the grass.
• No caravans are to be parked by the river, nor tents or other temporary accommodation erected unless with written approval from the owners or their Factor.
• The Countryside Code shall be observed at all times, no fires shall be lit and no litter may be left in or around the fishing huts, or around the river banks.
• If you or your authorised guests are found fishing by any of the prohibited methods or are found to be in breach of any of the terms and conditions of this offer you and your guests will be required to remove yourselves immediately from the river and the let will be terminated forthwith without any compensation being payable.
• You should enter in the book in the hut details of all fish caught by you and your authorised guests, naming the pools where the fish were caught and the lure on which they were taken. Fish caught and returned to the water are to be included in the appropriate column.
• All weeks are let for a maximum of 4 rods, although it is acknowledged that this may be too many in summer water conditions.
• The Trustees reserve the right for one rod to fish the water on any day and any fish caught by the rod will be included in your fishing return and noted as being so caught. This right may be exercised intermittently and shall not be exercised to the detriment of the tenant’s enjoyment.
